Terms and conditions of sale

2. Purpose

MYN07 Technologies provides digital marketing services: website design and hosting, organic and paid search, social media and Google Business Profile management, and the production of communication visuals.

These services are sold as monthly plans whose contents are described on the Pricing page. The description in force at the time of subscription prevails.

3. Subscription and formation of the contract

Subscriptions are taken out online from the Pricing page. The client selects a plan, provides their contact and payment details, then confirms the order.

The contract is formed when the subscription is accepted and an initial charge is authorised. A confirmation is sent by email to the address provided.

The client warrants the accuracy of the information supplied. A valid email address is essential: it serves as the identifier for client area access and as the channel for contractual communications.

4. Prices and taxes

Prices are stated in Canadian dollars (CAD). Applicable taxes (GST and QST) are added to the displayed amount where chargeable.

MYN07 Technologies reserves the right to change its prices. Any change has no effect on subscriptions already in force and applies only after prior notice to the client, with reasonable advance warning allowing them to cancel if they do not accept the new price.

5. Payment terms

Payment is made by credit or debit card, through an automatic recurring charge at the frequency of the plan subscribed to.

Payments are processed by Clover, a payment service provider. Card details are entered directly on Clover's secure servers: they do not pass through MYN07 Technologies' servers and are never stored there.

By subscribing, the client expressly authorises recurring charges until the subscription is cancelled.

6. Failed payments

If a payment is declined (expired card, insufficient funds, stop payment), the client is informed and invited to resolve the situation.

Failing resolution within a reasonable period, MYN07 Technologies may suspend the services concerned and then terminate the subscription. Suspension gives rise to no refund of periods already invoiced.

7. Term, renewal and cancellation

Subscriptions carry no minimum commitment and renew automatically at each due date.

The client may cancel at any time from their client area, without reason or penalty. Cancellation stops future charges; it does not give rise to a pro-rata refund of the current period, save in the cases set out in the refund policy.

MYN07 Technologies may terminate a subscription where the client fails to meet their obligations, in particular for non-payment or use contrary to these terms.

8. Client obligations

The client undertakes to supply in good time the material required to perform the services: content, access to the relevant accounts, approvals and feedback.

The client warrants that they hold the rights to the content they supply and that it infringes no third-party right or legal provision.

Any delay attributable to the client in supplying such material suspends neither invoicing nor the amounts due.

9. Intellectual property

Deliverables produced specifically for the client are assigned to them once paid for in full.

The methods, tools, templates and know-how used by MYN07 Technologies remain its exclusive property and are not assigned.

Services relying on third-party platforms (Google, Meta, hosting providers) remain subject to those platforms' own terms of use.

10. Liability

MYN07 Technologies is bound by an obligation of means. Search and advertising services depend on third-party algorithms and platform policies over which it has no control: no ranking, traffic or conversion outcome can be guaranteed.

MYN07 Technologies' liability, for all heads of loss combined, may not exceed the amounts actually paid by the client over the twelve months preceding the triggering event.

Nothing in these terms operates to exclude liability that cannot lawfully be excluded.

11. Personal information

Personal information collected is used solely to perform the contract, for invoicing and for related communications. It is neither sold nor transferred to third parties for commercial purposes.

Payment data is held by Clover, to whom it is transmitted directly.

In accordance with applicable Quebec legislation on the protection of personal information, the client has a right of access and rectification, exercisable at info@myn07technologies.com.

12. Amendments

MYN07 Technologies may amend these terms. The applicable version is the one in force on the date of subscription.

Any substantial change affecting a subscription in force is notified to the client with reasonable advance notice, allowing them to cancel if they do not accept it.

13. Governing law and jurisdiction

These terms are governed by the law applicable in the Province of Quebec and by the laws of Canada applicable therein.

The parties shall seek to settle any dispute amicably. Failing that, the courts of the judicial district of Québec shall have exclusive jurisdiction.

Where the client is a consumer within the meaning of the Consumer Protection Act, the mandatory provisions of that Act apply and prevail over any contrary clause herein.
